REPROGRAPHICS POLICIES

Photocopying is undertaken by staff and is at their discretion. Copies are charged at 25p each with a limit of 50 per user per day. Copies are supplied for private research on completion of a copyright form. Publication of documents is not permitted without the express permission of The Dartington Hall Trust Archive, and the Trust maintains the right to levy a fee for reproduction of its property. Scanned and digital photo images can be prepared for research purposes and reproduced on glossy paper at a cost of £4.50 each. All prices are subject to VAT.

COPYRIGHT COMPLIANCE

In general, copyright on published material is protected for 70 years following the end of the year of the author’s death, and in the case of photographs, 70 years after death of photographer or if photographer is unknown then 70 years after date of creation. Users must satisfy themselves that all necessary rights, releases or consents which may be required for publication or reproduction of documents or images are obtained, and The Dartington Hall Trust Archive gives no warranty or undertaking that any such rights, releases or consents are or will be obtained.

Photographs are displayed on-line for information purposes only and the necessary permissions are required before use. Every effort has been made to identify and contact the copyright holder. In those cases where the photographer is unknown and the photograph is outside of the copyright period, we have included the image. Should you discover what you consider may be a photograph of a known photographer, you should bring this immediately to the attention of the Archive by contacting the General Manager, giving full details. In addition, should you receive any notification from a third party relating to known photographers you should notify the General Manager giving full details of the photograph and photographer.

TERMS AND CONDITIONS FOR THE PUBLICATION OF DOCUMENTS OTHER THAN PHOTOGRAPHIC AND FILM MATERIALS

1. These Terms and Conditions apply to conventional reproduction or publication only. Reproduction or publication in an electronic or multimedia product is subject to separate terms and conditions.

2. Permission to publish or reproduce is dependent on the full acceptance of the terms and conditions detailed below and will be automatically withdrawn should any part be infringed.

3. The licensee is granted permission to publish or reproduce the document in the publication for the purpose only.

4. The rights that are granted to the licensee in respect of the document are non-exclusive. All reprints, further editions or use of the document, other than for the purpose, including publication or reproduction for an increase in the print run, necessitate a new application to The Dartington Hall Trust Archive and payment of a further fee (if appropriate). This also applies to television and radio programmes where permission to reproduce covers one transmission only.

5. Copyright in the document remains the property of The Dartington Hall Trust Archive unless otherwise stated.

6. The licensee must satisfy himself/herself that all necessary rights, releases or consents which may be required for publication or reproduction of the document are obtained, and The Dartington Hall Trust Archive gives no warranty or undertaking that any such rights, releases or consents are or will be obtained. In the event of the copyright being held by The Elmgrant Trust, The Dartington Hall Trust Archive will, on behalf of the licensee, undertake to seek to obtain the necessary rights, releases or consents required for publication or reproduction of the document.

7. The Licensee agrees to indemnify The Dartington Hall Trust Archive in respect of any claims or damages or any loss or costs arising in any manner from the reproduction or publication without proper rights or consents of the document.

8. The Dartington Hall Trust Archive shall not be liable for any loss or damage suffered by the licensee or by any third party arising from the use of the document.

9. All publication or reproduction of the document must include the appropriate citation and acknowledgement to The Dartington Hall Trust Archive..

10. If the document has not previously been published then any publication rights therein are hereby assigned absolutely to The Dartington Hall Trust for the full period of such publication rights.

11. Service fees may be charged to cover administrative costs and despatch of the document. Licensees will be warned of these charges in advance. Payment of service fees does not give rise to any rights in the document.

12. The licensee must pay the fee payable (if appropriate) by reference to the scale of fees set out in the schedule to this agreement.

13. Payment of the fee (if appropriate) should be made within 30 days of invoicing. All bank charges must be borne by the licensee.

14. Cheques must be made payable to The Dartington Hall Trust.

15. A copy of the publication is to be placed in The Dartington Hall Trust Archives.

16. No variation of the terms and conditions set out herein shall be effective unless agreed in writing by both parties.
